Rise MyCare (“Rise MyCare“) operates RiseMyCare.com and may operate other websites. It is Rise MyCare’s policy to respect your privacy regarding any information we may collect while operating our websites.

 

Website Visitors

 

Like most website operators, Rise MyCare collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Rise MyCare’s purpose in collecting non-personally identifying information is to better understand how Rise MyCare’s visitors use its website. From time to time, Rise MyCare may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

 

Rise MyCare also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on RiseMyCare.com blogs/sites. Rise MyCare only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that commenter IP addresses and email addresses are visible and disclosed to the administrators of the blog/site where the comment was left.

Gathering of Personally-Identifying Information

 

Certain visitors to Rise MyCare’s websites choose to interact with Rise MyCare in ways that require Rise MyCare to gather personally-identifying information. The amount and type of information that Rise MyCare gathers depends on the nature of the interaction. For example, we ask visitors who sign up at RiseMyCare.com to provide a username and email address. Those who engage in transactions with Rise MyCare are asked to provide additional information, including as necessary the personal and financial information required to process those transactions. In each case, Rise MyCare collects such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with Rise MyCare. Rise MyCare does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Aggregated Statistics

Rise MyCare may collect statistics about the behavior of visitors to its websites. Rise MyCare may display this information publicly or provide it to others. However, Rise MyCare does not disclose personally-identifying information other than as described below.

Protection of Certain Personally-Identifying Information

Rise MyCare discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that (i) need to know that information in order to process it on Rise MyCare’s behalf or to provide services available at Rise MyCare’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using Rise MyCare’s websites, you consent to the transfer of such information to them. Rise MyCare will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, Rise MyCare discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when Rise MyCare believes in good faith that disclosure is reasonably necessary to protect the property or rights of Rise MyCare, third parties or the public at large. If you are a registered user of a Rise MyCare website and have supplied your email address, Rise MyCare may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with Rise MyCare and our products. If you send us a request (for example via email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. Rise MyCare takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. Rise MyCare uses cookies to help Rise MyCare identify and track visitors, their usage of Rise MyCare website, and their website access preferences. Rise MyCare visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using Rise MyCare’s websites, with the drawback that certain features of Rise MyCare’s websites may not function properly without the aid of cookies.

Business Transfers

If Rise MyCare, or substantially all of its assets, were acquired, or in the unlikely event that Rise MyCare goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Rise MyCare may continue to use your personal information as set forth in this policy.

Privacy Policy Changes

Although most changes are likely to be minor, Rise MyCare may change its Privacy Policy from time to time, and in Rise MyCare’s sole discretion. Rise MyCare encourages visitors to frequently check this page for any changes to its Privacy Policy. If you have a Rise MyCare.com account, you might also receive an alert informing you of these changes. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.

California Residents

If you are a California resident, you have the right to know what personal information we collect, use, disclose or sell about you under the CCPA. Additionally, you have the right to access and delete your personal information.

How to request access to your personal information: You may request access to your personal information twice in a 12-month period. To do so, please email us at info@risemenshealth.com with the subject heading “California Privacy Rights” or call 817-900-0304. In response, we will produce an Access Report detailing the personal information we have collected, disclosed, and/or sold about you. This Access Report will be delivered by mail or electronically at your request. Note, we may not always be able to fully address your request, for example, if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way. Please be aware that not all information sharing is covered by the California Privacy Rights requirements and only information on covered sharing will be included in our response.

How to request deletion of your personal information: You may request that we delete the personal information it has collected and/or maintained about you. To do so, please email us at info@risemenshealth.com, or call 817-900-0304. Note, we may need to retain certain personal information as permitted by law, such as to complete the transaction for which the personal information was collected, maintain an electronic medical record for a Medical Group or Provider, provide a requested good or service, detect security incidents, protect against malicious, deceptive, fraudulent or illegal activities, comply with legal obligations or to enable solely internal uses that are reasonably aligned with your expectations or lawful within the context in which you provided the information.

We reserve the right to charge a fee where permitted by law, for instance, if your request is manifestly unfounded or excessive. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Please note, we will take steps to verify your identity before fulfilling any of the above requests. If you maintain an account with us, we will verify your identity through existing authentication practices for the account.

If you are not a registered member, we will verify your identity by matching two or three data points that you provide with data points that we maintain and have determined to be reliable for the purposes of verification.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. In order to designate an authorized agent to make a request on your behalf, you must provide written proof that you have consented to this designation unless the agent has power of attorney pursuant to California Probate Code sections 4000-4465. You must also verify your identity directly with us by providing a copy of your government issued identification. The California “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes.

We do not share your personal information with third parties for their own direct marketing purposes.

Response Timing and Format: If you are a Rise MyCare customer with an online account, we will deliver our written response to that account online or via email. If you are not a Rise MyCare customer or do not have an online account, we will deliver our written response by mail or electronically, at your preference. The response will also explain the reasons we cannot comply with a request, if applicable. Please note, that if you are submitting a request regarding information you provided to a Medical Group, a Providers, or a Pharmacy, your request should be directed to that entity.

Anti-Discrimination Right: We will not discriminate against you for exercising any of your CCPA rights. But note that some of the functionality and features available to you may change or no longer be available to you upon deletion of your personal information or opt-out of sale of your personal information.

PRIVACY INFORMATION FOR NEVADA RESIDENTS

Under Nevada law, certain Nevada consumers may opt out of the sale of “personally identifiable information” for monetary consideration (as such terms are defined under Nevada law) to a person for that person to license or sell such information to additional persons.  We do not engage in such activity; however, if you are a Nevada resident who has purchased services from us, you may submit a request to opt out of any potential future sales under Nevada law by info@risemenshealth.com.   Please note we will take reasonable steps to verify your identity and the authenticity of the request.  Once verified, we will maintain your request in the event our practices change.
